A judicial committee ruled in favor of the landowners and nullified enforcement proceedings conducted against their residential plots, sealing a victory for investors in the Falconcity of Wonders development who filed entitlement suits after years of legal warfare. Precautionary attachments and auction procedures imposed on parcels inside the Falconcity of Wonders project, notably in the Wadi Al Safa 2 area, were canceled by the Dubai special court in a February 16 ruling that upheld investors’ ownership rights.

An emotional Abu Ahmad told Khaleej Times, “We got the judgement in our favor.” The 54-year-old Indian expat’s voice was filled with relief and joy. “The plot is now ours. Even though it took over two years and three months, the wait was justified. Following a legal disagreement between Falcon Properties and Dubailand (LLC), the plots on which their homes were built were put up for auction, causing several Dubai residents who had invested in the project to fear they may lose their homes and life savings.

The conflict started when Dubai Land LLC sought to attach and auction several plots, including land that had already been sold to third parties and title papers produced, based on an arbitration verdict and a different court decision against Falconcity of Wonders LLC. Enforcement is the process of recovering debts resulting from a judgment or arbitration award through court-ordered procedures, such as attaching (freezing) or auctioning a property.
