The Al Ain Court of First Instance dismissed a lawsuit against another person. The lawsuit demanded Dhs35,000 in debt repayment, Dhs10,000 in material and moral compensation, a 12% delay interest on the amount owed from the date of the judicial claim until full payment, and fees, expenses, and legal fees.
According to the appellant, he transferred Dhs141,000 from his account to the appellee’s, who paid off a portion but refused to pay the remaining amount. In addition to requiring him to pay, the appellee filed a memorandum asking that the plaintiff be given the decisive oath and that the case be assigned for inquiry. The plaintiff also produced a copy of the bank transfers.
In addition, the appellee claimed that he had borrowed any money from the plaintiff, claiming that the sums they had exchanged were for modest business ventures and that he owed him nothing.
The court ordered the appellee to take the definitive oath through one of the audio-visual connection channels. He swore that he had not borrowed Dhs141,000 from the plaintiff and that no amount was owed on his loan.
The plaintiff requested that the appellee take the decisive oath, and the appellee did, the court explained. This resolved the dispute and confirmed that his debt was not outstanding for the sum claimed. Consequently, the court dismissed the lawsuit.
