
The federal judge presiding over Kilmar Abrego Garcia’s lawsuit challenging his detention and expulsion from the United States is bringing Trump administration officials to court to uncover the government’s intentions regarding the Salvadoran immigrant who was wrongly deported.
Ahead of his trial on smuggling charges, Abrego Garcia, whose case has been at the core of Donald Trump’s mass deportation program, is being detained in federal prison. The Department of Justice claims that if he is freed from pretrial detention, immigration officials plan to detain and deport him once more before a trial even starts.
District Judge Paula Xinis is directing Department of Homeland Security officials to testify regarding their plans for Abrego Garcia’s removal after government attorneys and senior Trump administration officials made a number of contradictory statements regarding his fate in recent weeks. The answers could indicate whether the criminal charges against him were related to his failure to follow court orders for his return.
On July 7, she set a hearing date. As early as July 16, Abrego Garcia may be freed from federal custody and sent to Homeland Security. Justice Department attorney Jonathan Guynn stated at a hearing in Maryland on Monday that the government had no plans to place Abrego Garcia in “limbo” with Immigration and Customs Enforcement pending a criminal prosecution.
