
A case involving unpaid pay, termination without due notice, and other employment-related allegations has been decided in favor of an employee by the Abu Dhabi Labour Court. The company was ordered by the First Instance Court to give the employee Dh50,930 in addition to Dh1,500 for an experience certificate and a return ticket to his home country.
The employee said in the court action that his employer did not pay his wage from October 1, 2024, until April 5, 2025, when he left the company. In addition, he requested compensation for his return airfare to his home country, unused annual vacation, wrongful dismissal, and lack of notice.
In a counterclaim, the employer requested Dh12,200, denying these allegations and claiming the employee had collected invoice payments but had not turned over the funds. Due to the lack of a prior agreement, the court denied the request for 12% interest on the outstanding balance and determined that there was no proof of an unjust dismissal brought about by a complaint or legal action.
After accepting sworn testimony that the employee had accepted payments but neglected to turn them over, the court decided in favor of the corporation in the employer’s counterclaim and ordered the employee to pay Dh12,200.
