On Friday, Italian officials said that they were sending 40 migrants to Italian-run migration holding facilities in Albania without permitting them to stay in the nation. It seems to be the first instance of an EU country rejecting migrants and sending them to a country outside the EU that is not their home country or one where they passed through on their way.

The refugees will be housed at migrant camps in Gjader and Shengjin port, which are constructed and operated by Italians and are situated 66 kilometers northwest of Tirana, the country’s capital. They were constructed to handle asylum requests from migrants whom Italy had seized in the Mediterranean Sea. However, Italian courts have prevented authorities from utilizing them since their October inauguration, and small groups of migrants have been sent back to Italy.

Last month, a decree that extended the use of the Albanian fast-track refugee processing centers to include the custody of rejected asylum seekers with deportation orders was authorized by Premier Giorgia Meloni’s far-right-led government in Italy.

Although the declaration was consistent with a previous proposal by the EU Commission that would permit EU nations to establish so-called “return hubs,” the idea has not yet received full approval.

Lawyers and migrant rights groups claim it creates a risky precedent and infringes on the right to apply for asylum. According to migration experts contacted by The Associated Press, it’s unclear how lawful Italy’s actions were, and they would probably face legal challenges.
